when i try to run one of the sample's i am getting this error:

I havent made any changes to the files, just unzipped them and compiled (after converting to .net 2 for vs2008)

Please take a look at the log file to see if all files could be loaded.

where do i find the log file?

after ignoring the error message the sample does run but it's no good having a game that has an error message on start up

This is an assertion. It is not shown when compiling the engine in release mode.
